The information, software, products, and services provided on amezly.com and through any Amezly application, API, or communication channel are provided by Amezly Technologies ("Amezly", "we", "our", "us") strictly on an "as is" and "as available" basis.
Amezly makes no representations or warranties of any kind, express or implied, as to the operation of its services, the accuracy of information displayed, or the fitness of the software for any particular purpose. Your use of any Amezly product is entirely at your own risk and discretion.

2 AI & Accuracy Disclaimer
Amezly's products are powered by artificial intelligence, including large language models (LLMs), retrieval-augmented generation (RAG), speech-to-text (STT), and text-to-speech (TTS) systems. While we invest significantly in model quality and accuracy, AI systems are inherently probabilistic and imperfect.

AI Output Disclaimer
Amezly makes no guarantee that AI-generated outputs are accurate, complete, current, suitable for any specific purpose, or free from errors. AI responses generated by Amezly's chatbot, voice agent, or any other AI feature:
- May contain factual inaccuracies, outdated information, or hallucinations
- Should not be relied upon as the sole basis for business, financial, legal, or medical decisions
- May vary between identical or similar inputs due to model temperature and stochastic generation
- May not reflect the most current information if your knowledge base has not been updated
- May misunderstand slang, regional dialects, technical jargon, or ambiguous phrasing
- Are generated by AI and do not constitute advice from a qualified human professional

Your responsibility as the business owner
You, as the Amezly account holder, are responsible for reviewing and approving the content your AI chatbot delivers to your customers. Amezly provides the platform and AI capability; you are responsible for the accuracy of your product catalogue, FAQ documents, pricing information, and any other data you upload to train or configure your chatbot. Amezly is not liable for incorrect information delivered to your customers if that information originated from data you provided.

Multilingual AI limitations
Amezly supports Hindi, Bengali, Tamil, Telugu, and English. While we continuously improve multilingual accuracy, performance may vary across languages. Regional dialects (e.g. Bhojpuri, Marathi, Gujarati) may not be fully supported and responses may default to a standard form of the language. We do not warrant perfect linguistic accuracy in any language.
3 No Warranty Disclaimer
To the maximum extent permitted by applicable law, Amezly Technologies expressly disclaims all warranties of any kind, whether express, implied, statutory, or otherwise, including but not limited to:

Warranties Disclaimed
- Implied warranties of merchantability — We make no warranty that the service is of satisfactory quality or fit for ordinary use
- Fitness for a particular purpose — We make no warranty that the service will meet your specific business requirements
- Non-infringement — We make no warranty that your use of the service will not infringe the intellectual property rights of any third party
- Accuracy and reliability — We make no warranty that information on the site or generated by AI is accurate, reliable, or complete
- Uninterrupted service — We make no warranty that the service will be available at all times, free from errors, or free from viruses or harmful components
- Security — While we implement industry-standard security measures, we make no warranty that the service is completely secure or that data transmissions are 100% secure
- Results — We make no warranty that use of the service will result in any specific business outcome, revenue increase, lead generation level, or other result
Some jurisdictions do not allow the exclusion of implied warranties. In such cases, the foregoing exclusions apply to the fullest extent permitted by applicable law in your jurisdiction. Our liability in such jurisdictions shall be limited to the minimum required by law.
4 Limitation of Liability
To the maximum extent permitted by applicable Indian law, in no event shall Amezly Technologies, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages — including but not limited to loss of profits, loss of data, loss of goodwill, loss of customers, or business interruption — even if Amezly has been advised of the possibility of such damages.

Aggregate Liability Cap
Amezly's total aggregate liability to you for all claims arising out of or related to the use of its services shall not exceed the amount you paid to Amezly in the 12 months immediately preceding the claim. If you are on a free or trial plan, Amezly's total liability shall not exceed ₹5,000.

Lost Revenue or Profits
Amezly is not liable for lost sales, missed leads, reduced revenue, or loss of business opportunities arising from service downtime, AI errors, or feature unavailability.

Data Loss
While we maintain backups, Amezly is not liable for loss of customer data, conversation logs, uploaded files, or analytics data due to technical failures, cyberattacks, or human error.

Third-Party Actions
Amezly is not liable for actions, failures, or outages of third-party services including MSG91, Razorpay, Vobiz, Google, Meta, OpenRouter, or any integration partner.

Customer Complaints
Amezly is not liable for complaints, disputes, refund demands, or legal claims raised by your end customers arising from responses delivered by your AI chatbot or voice agent.

Unauthorised Access
Amezly is not liable for damages resulting from unauthorised access to your account due to weak passwords, credential sharing, phishing attacks, or compromised devices.

Internet Failures
Amezly is not responsible for service interruptions caused by internet connectivity failures, ISP outages, infrastructure provider downtime, or force majeure events.
5 Results & Performance Disclaimer
Amezly's website, marketing materials, case studies, and sales communications may contain references to specific business outcomes achieved by customers — such as revenue growth percentages, lead conversion rates, appointment booking increases, or cost savings.

Results Disclaimer
Past results achieved by other Amezly customers are not a guarantee, warranty, or promise of results you will achieve. Business outcomes depend on many factors outside Amezly's control, including but not limited to:
- The quality, completeness, and accuracy of data you provide to configure the AI
- Your industry, local market conditions, and competitive landscape
- The nature and volume of your existing customer base and web traffic
- How consistently and correctly you use Amezly's features
- Your pricing, product quality, customer service, and brand reputation
- Seasonal, economic, or regulatory factors affecting your business
- Integration quality with your existing e-commerce, CRM, or booking systems

Amezly does not validate chatbot responses against sector-specific regulations. You must implement your own compliance review process.
9 Indemnity
By using Amezly's services, you agree to indemnify, defend, and hold harmless Amezly Technologies, its directors, officers, employees, and agents from and against any claims, liabilities, damages, judgements, awards, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to:

10 Service Availability Disclaimer
Amezly aims for 99.5% monthly uptime for paid plans. However, we do not unconditionally guarantee uninterrupted availability and reserve the right to perform scheduled maintenance, emergency patches, and infrastructure upgrades that may temporarily affect service.

Availability Disclaimer
- Scheduled maintenance windows are communicated at least 48 hours in advance via dashboard notification and email
- Emergency security patches may be deployed without prior notice to protect platform integrity
- Amezly is not liable for service interruptions caused by force majeure events including natural disasters, power failures, internet backbone outages, government orders, or cyberattacks beyond our reasonable control
- AI response latency may increase during periods of high platform load — Amezly does not guarantee specific response time SLAs except where explicitly contracted in an Enterprise agreement
- The free and Starter plans do not include uptime SLA guarantees — service is provided on best-effort basis
- Feature availability may differ by plan — features shown in marketing materials may require a specific subscription tier
11 Jurisdiction & Governing Law
These disclaimers and all matters related to your use of Amezly's services are governed by the laws of India. The courts of Bangalore, Karnataka shall have exclusive jurisdiction over all disputes arising from or related to these disclaimers, unless otherwise agreed in writing.

Governed by Indian Contract Act 1872, Information Technology Act 2000, IT (Amendment) Act 2008, Digital Personal Data Protection Act 2023, Consumer Protection Act 2019, and applicable GST regulations. Disputes subject to exclusive jurisdiction of courts in Bangalore, Karnataka.

International Users
Users accessing Amezly from outside India do so at their own initiative and are responsible for compliance with their local laws. Amezly makes no representation that its services are appropriate or available in all jurisdictions. Users in the EU/UK should note that GDPR/UK GDPR may also apply to their personal data.

Dispute Resolution
Before initiating legal proceedings, both parties agree to attempt resolution through good-faith negotiation for 30 days. If unresolved, disputes shall be referred to arbitration under the Arbitration and Conciliation Act 1996, with the seat of arbitration in Bangalore, conducted in English.
12 Updates to These Disclaimers
Amezly Technologies reserves the right to modify, update, or replace these disclaimers at any time without prior notice. The "Effective" date at the top of this page will be updated to reflect the date of the most recent revision.
Your continued use of amezly.com or any Amezly product after the effective date of a revised disclaimer constitutes your acceptance of the updated terms. If you do not agree with any revised disclaimer, you must discontinue use of Amezly's services.

For material changes to these disclaimers — particularly those that expand Amezly's liability exclusions or significantly affect your rights — we will provide at least 14 days' notice via email to registered account holders and a banner on the Amezly dashboard. Minor clarifications and corrections may be made without notice.
